These Terms of Service ("Terms") govern your use of shestopsscrolls.com (the "Site"), operated by Apex Unity Brands LLC, a Delaware limited liability company, doing business as She Stops Scrolls ("we," "us," or "our"), located at 800 North King St., Wilmington, DE 19801. By using the Site, submitting the questionnaire, or booking a call, you agree to these Terms. If you do not agree, do not use the Site.
The Site describes our advertising creative services and lets prospective clients request a consultation call. The Site itself does not sell products, process payments, or create a client engagement. Any actual services are governed by a separate written agreement signed by both parties; if there is a conflict between these Terms and a signed services agreement, the services agreement controls.
Booking a call is free and creates no obligation on either side. We may decline, reschedule, or cancel a consultation at our discretion. Anything discussed on a consultation call is general information, not professional advice tailored to your circumstances, and you are responsible for your own business decisions.
We do not guarantee any particular business outcome, including advertising performance, cost per lead, return on ad spend, revenue, or profit. Advertising results depend on many factors outside our control, including your offer, pricing, market, budget, and the policies and algorithms of advertising platforms. Any examples or figures discussed on the Site, in emails, or on calls are illustrations of how advertising mechanics work, not promises of results. Your results may vary. This does not limit any specific service deliverables (such as creative volume or turnaround time) stated in a signed services agreement, which are governed by that agreement.
The Site is intended for business users aged 18 or older. You agree to provide accurate information in the questionnaire and booking process, and not to misuse the Site, including by submitting false information, interfering with its operation, scraping, or attempting to access systems or data you are not authorized to access.
The Site and its content, including text, design, graphics, and logos, are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, except for your own personal, non-commercial reference.
The Site relies on third-party services, including Calendly for scheduling and Meta platforms for advertising. Those services are governed by their own terms and privacy policies, and we are not responsible for their availability or conduct. The Site is not part of, or endorsed by, Facebook (Meta Platforms, Inc.), Google, or YouTube. FACEBOOK is a trademark of Meta Platforms, Inc.; GOOGLE and YOUTUBE are trademarks of Google LLC.
By submitting the questionnaire or booking a call, you agree that we may contact you by email and, if you provide a phone number, by phone, about your inquiry and related educational content. You can opt out of marketing emails at any time by using the opt-out mechanism in the email or replying and asking us to stop. We do not send automated marketing text messages without your separate consent.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX UNITY BRANDS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute arising out of these Terms or the Site will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms are the entire agreement between you and us regarding use of the Site.
